About this listen
A guide to the American legal system, told through the story of two actual court cases.
The Steps to the Supreme Court takes a lively, narrative approach to the subject by following two real cases - one civil, one criminal - as they work their way through the system, all the way up to the Supreme Court. Written by a member of the Supreme Court bar, this book brings the legal system to life in a practical, accessible, and compelling way.
- Covers the key legal terms, principles, and processes you need to have a basic grasp of the American legal system.
- Tracks the criminal case involving the murder trial of Paul House and follows the defendant from the night of the murder through his conviction, appeals, and final chance for exoneration at the hands of the Supreme Court.
- Follows a civil case concerning the Ten Commandments being displayed on public property, following the parties from the time the plaintiffs filed their complaints, through the Supreme Court decisions, and back to the aftermath in the lower courts, as they wrestle with a divided complex ruling.
- Written by the author of A People's History of the Supreme Court, and other classic works on the American justice system.

Story
The conventional wisdom about Felix Frankfurter―Harvard law professor and Supreme Court justice―is that he struggled to fill the seat once held by Oliver Wendell Holmes. Scholars have portrayed Frankfurter as a judicial failure, a liberal lawyer turned conservative justice, and the Warren Court’s principal villain. And yet none of these characterizations rings true.

Arguably the most important American lawyer of the 20th century, Thurgood Marshall was on the verge of bringing the landmark suit Brown v. Board of Education before the US Supreme Court when he became embroiled in a case that threatened to change the course of the civil rights movement and to cost him his life. In 1949, Florida's orange industry was booming, and citrus barons got rich on the backs of cheap Jim Crow labor with the help of Sheriff Willis V. McCall, who ruled Lake County with murderous resolve....

Judge Cordell, the first African American woman to sit on the Superior Court of Northern California, knows firsthand how prejudice has permeated our legal system. And yet, she believes in the system. From ending school segregation to legalizing same-sex marriage, its progress relies on legal professionals and jurors who strive to make the imperfect system as fair as possible. Story
In recent years, the high-profile murders of George Floyd, Breonna Taylor, and so many others have brought much-needed attention to the pervasiveness of police misconduct. Yet it remains nearly impossible to hold police accountable for abuses of power—the decisions of the Supreme Court, state and local governments, and policy makers have, over decades, made the police all but untouchable. In Shielded, University of California, Los Angeles, law professor Joanna Schwartz exposes the myriad ways in which our legal system protects police at all costs.

Ascending to the leadership role of US Attorney for the Southern District, which includes Manhattan and several counties to the north, is a capstone to any legal career: it entails guiding a team of the best lawyers in America in selecting and winning cases that often have global import. Geoffrey Berman was honored to be tapped for the job by Donald Trump in 2018. The manner in which Trump had dispatched his predecessor Preet Bharara was troubling, but the institution was fabled for its independence. Surely he could manage.

Story
Democrats, the news media, and many leading Republicans immediately blamed the roughly four-hour disturbance on President Trump. The president “incited an insurrection”, the American pubic was told. But one year later, the original narrative of what happened that day has crumbled while hundreds of Americans have been swept up in an unprecedented investigation led by Joe Biden’s Justice Department to punish them for their involvement in the January 6 protest. The public has been misled - and flat-out lied to - about that day. This book exposes them all.

Not since The Thin Blue Line has there been a true-crime saga as engrossing as Making a Murderer. Captivating audiences across demographic lines, it made Steven Avery a household name and thrust defense attorney Jerome F. Buting - and his fight against America's dysfunctional criminal justice system - into the spotlight. In Illusion of Justice, Buting uses the Avery case as a springboard to examine the shaky integrity of our law enforcement and legal systems, which he has witnessed firsthand for nearly four decades.

In the past thirty years alone, more than 2,800 innocent American prisoners—their combined sentences surpassing 25,000 years—have been exonerated and freed after being condemned for crimes they did not commit. Terrifyingly, this number represents only a fraction of the actual number of persons wrongfully accused and convicted over the same period.

Story
In January 1982, an elderly white widow was found brutally murdered in the small town of Greenwood, South Carolina. Police immediately arrested Edward Lee Elmore, a semiliterate, mentally retarded black man with no previous felony record. His only connection to the victim was having cleaned her gutters and windows, but barely ninety days after the victim’s body was found, he was tried, convicted, and sentenced to death. Elmore had been on death row for eleven years when a young attorney named Diana Holt first learned of his case.

Story
Nearly 5,000 black Americans were lynched between 1890 and 1960. Over 40 years later, Sherrilyn Ifill examines the numerous ways that this racial trauma still resounds across the United States. While the lynchings and their immediate aftermath were devastating, the little-known contemporary consequences, such as the marginalization of political and economic development for black Americans, are equally pernicious. A landmark book, On the Courthouse Lawn is a much-needed and urgent road map for communities finally confronting lynching's long shadow.

Story
In the 2018 best seller The Case Against Impeaching Trump, Alan Dershowitz lamented how American political discourse has devolved into hypocrisy and the criminalization of political differences. Arguments to impeach Trump failed Dershowitz’s “shoe on the other foot test”, or his political golden rule: Democrats must do unto Republicans what they would have Republicans do unto them, and vice versa. Since then, we’ve only become more divided. The Case Against the Democratic House Impeaching Trump includes and expands upon Dershowitz’s 2018 book.

On September 9, 1971, nearly 1,300 prisoners took over the Attica Correctional Facility in upstate New York to protest years of mistreatment. Holding guards and civilian employees hostage, the prisoners negotiated with officials for improved conditions during the four long days and nights that followed. On September 13, the state abruptly sent hundreds of heavily armed troopers and correction officers to retake the prison by force. Their gunfire killed 39 men - hostages as well as prisoners.

Story
Arguably the most important American lawyer of the 20th century, Thurgood Marshall was on the verge of bringing the landmark suit Brown v. Board of Education before the US Supreme Court when he became embroiled in a case that threatened to change the course of the civil rights movement and to cost him his life. In 1949, Florida's orange industry was booming, and citrus barons got rich on the backs of cheap Jim Crow labor with the help of Sheriff Willis V. McCall, who ruled Lake County with murderous resolve....

Story
On September 15, 1963, the 16th Street Baptist Church in Birmingham, AL, was bombed, killing four young girls. Who were the perpetrators? Due to reluctant witnesses and racial prejudice, the FBI closed the case without any indictments. But as Martin Luther King, Jr., claimed, "the arc of the moral universe is long, but it bends toward justice." Bending Toward Justice is a detailed account of this key moment in our national struggle for equality and the long road to prosecuting those responsible for the tragedy, related by an author who played a major role in the investigation.

Story
On a bitterly cold afternoon in December 1986, a Michigan State trooper found the frozen body of Jerry Tobias in the bed of his pickup truck. The 31-year-old oil field worker and small-time drug dealer was clad only in jeans, a checkered shirt, and cowboy boots. Inside the cab of the truck was a fresh package of expensive steaks from a local butcher shop, the first lead in a case that would be quickly lost in a thicket of bungled forensics, shady prosecution, and a psychopathic star witness out for revenge.

Story
The Supreme Court's decision in Brown v. Board of Education is widely considered a seminal point in the battle to end segregation, but it was in fact the culmination of a decades-long legal campaign. Root and Branch is the epic story of the two fiercely dedicated lawyers who led the fight from county courthouses to the marble halls of the Supreme Court, and, in the process, laid the legal foundations of the civil rights movement.

good technical review of supreme Court cases
although I enjoyed listening to this book and I believe it was presented quite well. there was clearly some bias as a author which is to be expected and unfortunately is common in the practice of law. we all do have our opinions but as lawyers we say what we think the law is and the judges decide what the law is in that this was quite an interesting and eye-opening book.
