About this listen
Many of the political issues we struggle with today have their roots in the US Constitution.
Husband-and-wife team Cynthia and Sanford Levinson take listeners back to the creation of this historic document and discuss how contemporary problems were first introduced - then they offer possible solutions. Think Electoral College, gerrymandering, even the Senate. Many of us take these features in our system for granted. But they came about through haggling in an overheated room in 1787, and we're still experiencing the ramifications.
Each chapter in this timely and thoughtful exploration of the Constitution's creation begins with a story - all but one of them true - that connects directly back to a section of the document that forms the basis of our society and government. From the award-winning team - Cynthia Levinson, children's book author, and Sanford Levinson, constitutional law scholar - Fault Lines in the Constitution will encourage exploration and discussion from young and old listeners alike.
Read by Mark Bramhall, Arthur Morey, Kimberly Farr, Erin Spencer, and Adenrele Ojo.

Americans tend to cast slavery as a pre-modern institution - the nation's original sin, perhaps, but isolated in time and divorced from America's later success. Baptist reveals in The Half Has Never Been Told, the expansion of slavery in the first eight decades after American independence drove the evolution and modernization of the United States.

Story
Bryan Stevenson was a young lawyer when he founded the Equal Justice Initiative, a legal practice dedicated to defending those most desperate and in need: the poor, the wrongly condemned, and women and children trapped in the farthest reaches of our criminal justice system. One of his first cases was that of Walter McMillian, a young man who was sentenced to die for a notorious murder he insisted he didn’t commit. The case drew Bryan into a tangle of conspiracy, political machination, and legal brinksmanship—and transformed his understanding of mercy and justice forever.

Story
Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now a well-accepted mode of constitutional interpretation. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know the "original intent" of any provision.

For much of his life, historian Howard Zinn chronicled American history from the bottom up, throwing out the official version taught in schools - with its emphasis on great men in high places - to focus on the street, the home, and the workplace. Known for its lively, clear prose as well as its scholarly research, A People's History of the United States is the only volume to tell America's story from the point of view of - and in the words of - America's women, factory workers, African-Americans, Native Americans, the working poor, and immigrant laborers.

America is undergoing a massive experiment: It is moving, in fits and starts, toward a multiracial democracy, something few societies have ever done. But the prospect of change has sparked an authoritarian backlash that threatens the very foundations of our political system. Why is democracy under assault here, and not in other wealthy, diversifying nations? And what can we do to save it?

Democracies can die with a coup d'état - or they can die slowly. This happens most deceptively when in piecemeal fashion, with the election of an authoritarian leader, the abuse of governmental power and the complete repression of opposition. All three steps are being taken around the world - not least with the election of Donald Trump - and we must all understand how we can stop them.

Story
The framers of the Constitution battled over it. Lawmakers have tried to amend or abolish it more than 700 times. To this day, millions of voters, and even members of Congress, misunderstand how it works. It deepens our national divide and distorts the core democratic principles of political equality and majority rule. How can we tolerate the Electoral College when every vote does not count the same, and the candidate who gets the most votes can lose?

Behind the deeply contentious 2020 election stands a real story of a broken election process. Election fraud that alters election outcomes and dilutes legitimate votes occurs all too often, as is the bungling of election bureaucrats. Our election process is full of vulnerabilities that can be - and are - taken advantage of, raising questions about, and damaging public confidence in, the legitimacy of the outcome of elections.

In Defender in Chief, celebrated constitutional scholar John Yoo makes a provocative case against Donald Trump's alleged disruption of constitutional rules and norms. Donald Trump isn't shredding the Constitution - he's its greatest defender. Ask any liberal - and many moderate conservatives - and they'll tell you that Donald Trump is a threat to the rule of law and the US Constitution. Mainstream media outlets have reported fresh examples of alleged executive overreach or authoritarian White House decisions nearly every day of his presidency.

Voting is our most important right as Americans—“the right that protects all the others,” as Lyndon Johnson famously said when he signed the Voting Rights Act—but it’s also the one most violently contested throughout US history. Since the gutting of the act in the landmark Shelby County v. Holder case in 2013, many states have passed laws restricting the vote. After the 2020 election, President Trump’s effort to overturn the vote has evolved into a slow-motion coup, with many Republicans launching an all-out assault on our democracy.

Story
It wasn’t long ago that liberal icons, including the late Supreme Court Justice Ruth Bader Ginsburg, were against the idea of overhauling the court for political gain. But now, in the Biden era, more and more powerful Democrats are getting behind the cause, claiming the high court is broken and actively dismantling our democracy. Even Joe Biden—who once called court-packing a “bonehead idea”—gave in to the progressive wing of his party, appointing a committee to examine “reforms” to the court after being sworn in as president.

Taking his typically in-depth, historically informed view, Thom Hartmann asks: What if the Supreme Court didn't have the power to strike down laws? According to the Constitution, it doesn't. From the founding of the republic until 1803, the Supreme Court was the final court of appeals, as it was always meant to be. So where did the concept of judicial review start? As so much of modern American history, it began with the battle between the Federalists and Anti-Federalists, and with Marbury v. Madison.

America's political leaders have considered suffrage not a natural right but a privilege restricted by wealth, sex, race, residence, literacy, criminal conviction, and citizenship. Today, voter identification laws, political gerrymandering, registration requirements, felon disenfranchisement, and voter purges deny many millions of citizens the opportunity to express their views at the ballot box. We cannot blame the founders alone for America's embattled vote. Best-selling author Allan Lichtman notes that subsequent generations have failed to establish suffrage as a universal right.

Story
In The Four Threats, Lieberman and Mettler explore five historical episodes when democracy in the United States was under siege: the 1790s, the Civil War, the Gilded Age, the Depression, and Watergate. These episodes risked profound, even fatal, damage to the American democratic experiment, and on occasion antidemocratic forces have prevailed. From this history, four distinct characteristics of democratic disruption emerge. Political polarization, racism and nativism, economic inequality, and excessive executive power...have threatened the survival of the republic.

Story
The next red wave is coming: November 3, 2020. We face battles on many fronts. The Deep State bureaucracy will stop at nothing to undermine the conservative agenda, even when that's the agenda chosen by the American voter. The liberal bureaucracy will continue to work alongside former liberal government officials from, yes, the Obama Administration and Team Clinton. In this election, the Left's prized goal - exclusively - will be defeating President Donald Trump by whatever means necessary.

The Fierce Urgency of Now animates the full spectrum of forces at play during these turbulent years, including religious groups, the media, conservative and liberal political action groups, unions, and civil rights activists. Above all, the great character in the audiobook whose role rivals Johnson's is Congress - indeed, Zelizer argues that our understanding of the Great Society program is too Johnson-centric.

Encouraged by her mother to pursue her own ambitions, Toufah entered a presidential competition purportedly designed to identify the country's smart young women and support their educational and career goals. Toufah won. Yahya Jammeh, the dictator who had ruled The Gambia all of Toufah's life, styled himself as a pious yet progressive protector of women. At first he behaved in a fatherly fashion toward Toufah, but then proposed marriage, and she turned him down. On a pretext, his female cousin then lured Toufah to the palace, where he drugged and raped her.

A tremendous work. Clear, thorough, thoughtful
I am in my 34th year of teaching this at the college level. At this moment I'm doing it again, and sought a refresher and some new views. I was well rewarded here. This is one of the finest works I have seen. It has plenty of sophistication for an adult. It is very well-written and edited. It gives a good sense of what the framers faced, and what constraints they were under. They cut a lot of deals (perhaps unimaginable in these times in our USA), casting big shadows across our lives today. After the basics I got in high school government class (pretty miserably delivered, actually), this book would be a first recommendation for deepening understanding. If there is a slant one way or another, there is enough distance from the subject, and enough restraint, to not be bothersome to a reasonable listener.
Of special interest to me are the seeming design flaws in the alleged democracy in our country. For example, I as a voter for the U.S. Senate have a tiny micro-sliver of the political power of a voter in some small or rural states. This allows moneyed interests to target their attention to a few backwaters (pardon me) and lap me and my fellow members of a populous and prosperous state in federal power. This allows plenty more money per capita to be lavished on those fortunate voters, or more probably, concentrated into the hands of the elites influential in those places. And this is merely a sample of the distortions laid out plainly here.

Believe it or not, I considered this book to be a real "page turner".
This was apparently intended to be a middle-school/high-school age primer on the workings of -- and problems with -- the US Constitution. The authors, a world-renowned Constitutional Law scholar and his wife, an accomplished author, describe in accessible detail the highlights of the US Constitution. Interesting background stories are liberally peppered in to make the material more relevant to the less-informed reader. However, while the book may have been targeted at those in their early teens, the issues discussed are sophisticated indeed. Fine points of the US Constitution are compared with constitutions of individual states, as well as those of other countries. We are left with the distinct impression that our Constitution was, indeed, a spectacular accomplishment. HOWEVER, it is similarly clear that some of the compromises made at the onset, as well as some of the key features, have demonstrated themselves to be problematic in many ways (and could cause serious problems in several specific circumstances which haven't yet occurred). Among the radical, but arguably pragmatic suggestions is to call a new Constitutional Convention and perhaps start again from scratch! The authors themselves have an interesting dialogue with each other at the end discussing pros and cons of this quite radical suggestion.
So -- this book should appeal to many readers:
- Young or just relatively uninformed folks who'd like to better understand how our federal government is designed to work and why,
- More sophisticated readers who enjoy studying history,
- Folks who are interested in comparing how the US constitution does things compared with how other constitutions (i.e., those of individual states and of other countries) do them.
